Terms of Service
Payments: Third Tier provides services on an hourly basis at a rate of US $175.00 per hour. All services are paid in advance with a one-hour minimum to initiate a support session. Third Tier also provides micro-staffing at the rate of US $140 per hour purchased in packages only. Payment for services is handled through PayPal. Payments are non-refundable but can be applied against future support requests.
Assistance and Privacy: Third Tier utilizes independent contractors to perform most services on its behalf. Third Tier may need access to your systems in order to assist you with diagnosing and resolving the issues identified in your support request(s). Any remote access will be done with your permission only, and representatives of Third Tier will access only those systems authorized by you. Access to your systems may be done using any of a variety of commonly used remote access software. This software may be provided by you or Third Tier. In order for us to provide you with remote assistance, you may need to provide a Third Tier representative with your Administrator password. You may also be requested to create an additional Administrator-equivalent account to be used for access. By providing us with your Administrator password you are thereby giving us consent to access your system remotely in order to assist you with problem diagnosis and/or resolution.
Additionally, in order for Third Tier to effectively solve your problem, some machine configuration data may be collected. No personal data will be automatically collected. You are urged to delete or not share with us any material or information that you feel is confidential. You explicitly authorize Third Tier to access and utilize that information for the purpose of assisting you with problem diagnosis and/or resolution.
Immediately upon completion of the support we provide you we urge you to change your Administrator password as an extra precaution.
Without prejudice to any other rights, we may refuse to accept your support request or stop working on your support request if you fail to comply with the terms and conditions set forth herein.
DISCLAIMER OF WARRANTY
THE EQUIPMENT, CONFIDENTIAL INFORMATION AND ANY REMOTE DIAL-IN ASSISTANCE ARE PROVIDED TO YOU AS IS WITHOUT WARRANTY OF ANY KIND. THE ENTIRE RISK AS TO THE RESULTS, CONFIDENTIAL INFORMATION AND REMOTE DIAL-IN ASSISTANCE IS ASSUMED BY YOU. Third Tier DISCLAIMS ALL WARRANTIES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND WARRANTIES OF TITLE AND NON-INFRINGEMENT, WITH RESPECT TO THE EQUIPMENT, SERVICE AND CONFIDENTIAL INFORMATION.
LIMITATIONS OF LIABILITY
IN NO EVENT SHALL Third Tier BE LIABLE FOR ANY DIRECT, CONSEQUENTIAL, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR OTHER DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, INTERRUPTION, LOSS OF INFORMATION, AND THE LIKE, ARISING OUT OF THIS AGREEMENT, CONFIDENTIAL INFORMATION OR DAMAGES ARISING OUT OF ANY REMOTE ASSISTANCE, EVEN IF Third Tier HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
